Apple makes public response to Greenlight lawsuit claims

Apple has released a public statement in response to a new lawsuit by Greenlight Capital. "Contrary to Greenlight's statements, the adoption of Proposal #2 would not prevent the issuance of preferred stock," Apple writes. "Currently, Apple's articles of incorporation provide for the issuance of 'blank check' preferred stock by the Board of Directors without Shareholder approval." With Proposal 2 in effect, the company suggests, shareholders would have the right to approve an issuance of preferred stock.

AirPort Utility 6.2 extends printing, guest Wi-Fi support

Anticipated Mailbox app goes live on App Store

An anticipated iPhone email client, Orchestra's Mailbox, has gone live at the App Store. Downloading the app only puts a person into a reservation queue however, as Orchestra is managing the number of people able to access its services. Entries are on a first-come first-served basis.

Apple 'somewhat behind' on phone features, says Wozniak

The iPhone has fallen "somewhat behind" in terms of smartphone features, according to Apple co-founder Steve Wozniak. The comment emerged during Businessweek's Best Brand Awards. "I am proud that we have such loyal fans," he said. "But this loyalty is not given, the need to have the best products is always there. Currently we are in my opinion somewhat behind with features in the smartphone business. Others have caught up. Samsung is a big competitor. But precisely because they are currently making great products."

Greenlight sues Apple over proposed stock changes

Investment firm Greenlight Capital has filed suit against Apple over a proxy proposal for its stock, reports AllThingsD. The proposal would eliminate preferred stock from Apple's charter, but in a statement, Greenlight argues that shareholders should vote against it since it wouldn't maximize their profits. "Apple is a phenomenal company filled with talented people creating iconic products that consumers around the world love," claims Greenlight's David Einhorn. "But Apple has a problem, we think. It has a cash problem."
