[Hub] Greens/EFA co-presidents alerts EP President of ACTA-related maladministration complaints against Parliament

Dear all,

Please find attached (and verbatim below) a letter from Greens/EFA
Co-Presidents Daniel Cohn-Bendit and Rebecca Harms to the President of
the European Parliament Mr Martin Schulz.

The letter recognises the Ombudsman complaints filed on access to
ACTA-related documents, in particular the complaint by Mr Ante Wessels
on behalf of FFII, see:

Bearing in mind that the complaints concern the Parliament's activities
in a field in which its competences were greatly strengthened with the
Lisbon Treaty, that is international agreements, I think that the
Parliament's credibility would be damaged, would the Ombudsman confirm
the allegations are true.

It follows from the fact that the Parliament now has the power of
consent and the right to be fully informed at all stages of the
procedure concerning international agreements that the Parliament's
decision on concluding the same has to meet the highest democratic
standards provided for by the Treaties. If the Parliament is not seen to
respect this, and does not act in compliance with Article 103 of the
Rules of Procedure, I believe it would seriously undermine citizens'
confidence in the institution as a whole.

Dear Mr President,

As the Parliament's consent procedure on ACTA is commencing in several
Committees, we have been informed that the Ombudsman has received
complaints regarding access to documents related to ACTA requested under
Regulation 1049/2001.
 
The requests have concerned, amongst others, minutes of the
Coordinators' Meetings of the Committees involved.
 
The latest complainant, Ante Wessels representing FFII, accuses the
Parliament of denying the existence of documents that were later sent to
him by the Parliament services.
This is, as such, a violation of regulation 1049/2001, which obliges
Parliament to keep a register of all documents, even if some of these
are only mentioned on the register and not published on it.
 
We are concerned by these allegations and therefore ask you to fully
cooperate with the Ombudsman and make sure that our services and
institutions remain a model when it comes to transparency and citizens'
access to documents.
