ILTA 2012: E-discovery Trends

An overview of the e-discovery landscape and announcements at ILTA 2012.

E-discovery in general is not a major focus of ILTA, given how much of it law firms outsource to service providers - and increasingly how much corporate clients outsource to service providers directly or perform themselves, in-house.

Yet attorney review – the most costly part of e-discovery – is front and center, as hosting, legal process outsourcing, Alternate Fee Arrangements, and computer-assisted review create a “new normal” for service delivery and pricing.

These trends cropped up throughout sessions and briefings:

Fixed fees and AFAs were discussed in several sessions.
Predictive coding seemed more muted, as most vendors had either rolled it out for LegalTech 2012 in Q1, or were revving it up for next year.
But “value over volume” was an interesting trend, as providers sought to compete less on cost, avoiding the race-to-zero of per-GB pricing for a higher value add through better tech
"Earlier” Early Case Assessment seemed to be a theme, as analytics moved further and further upstream into processing and collection.

Did pricing pressure lead to greater technology purchasing and adoption for ILTA’s reported record 1450 attendees? While floor traffic was not overwhelming this year, a few vendors were buzzing about very recent big-figure wins, and seems like everyone had a new product or service offering to hype.

Announcements

AccessData announced Summation 4.1, addressing user-driven demand on fixes for the latest release of the “comeback kid” of review tools, featuring ePaper near-native viewer with auto-redaction. Summation is now integrated into v.4.0 of the AD eDiscovery platform, offering end-to-end internal response for the enterprise.
Service Provider Applied Discovery debuted “Relativity Amplified,” its suite of apps bolstering its recent partnership with kCura, including data tracking, project management, and ECA portal – as well as free predictive coding as part of an ILTA special.
CaseCentral and Guidance appeared post-acquisition behind CC’s R5 release of its hosted review tool and Guidance’s forthcoming rev of its in-house EnCase eDiscovery platform with one-click promotion, plus a new App Store unveiled at CEIC.
Catalyst demoed its Insight platform, with a GUI overhaul and new search courtesy of MarkLogic.
Clearwell appeared behind transparent predictive coding, and their newly-published Predictive Coding for Dummies.
Daegis brought new ex-Lexis CEO Deborah Jilson for the debut of its latest rev with more self-service for data loading and production in its cloud-based review platform, as well as support for LexisNexis CaseMap and Lotus Notes (a strength of its AXS-One archive, still under integration post-acquisition).
Equivio added free clustering to its Zoom platform’s 2.2 release, for predictive coding and more.
E-discovery platform player Exterro announced enhancements aimed at enterprise customers, including new language support in line with planned expansion to Europe, e-mail threading, “silent” legal holds, and more granular dedupe.
FTI demoed Ringtail 8, with integration of its Ringtail and Attenex Document Mapper products into one tool.
Service Provider Fios launched its Redaction Assistant for Relativity, starting at $25/GB for automating common redaction patterns (names, phrases, numeric patterns like Social Security or credit card numbers).We outlined the benefits in a recent lab white paper. Is it the dawn of Relativity app stores for service providers?
Review vendor iCONECT demoed its latest, Xera, with a GUI overhaul, Oracle backend and data analytics. The company is betting on the future with HTML5, Safari and iPad support, integration with Content Analyst, and predictive coding slated for LTNY13.
LPO and e-discovery service provider Integreon introduced more options for pure legal staffing, building on its “managed review” services.
kCura appeared demoing Relativity Assisted Review, their predictive coding integration with Content Analyst, this week releasing a case study with partner CDS Legal.
Kroll rolled out Verve 1.2, addressing user demands with a dot release in their first go at “productizing” via a SaaS review available separate from service engagements.
LexisNexis appeared behind Early Data Analyzer and the hosted version of Concordance Evolution.
MindsEye from the makers of OnSite (acquired by Integreon) boasts 25 partners for its “Earlier Early Case Assessment,” aimed at upstream analytics to minimize review.
Nuix announced a new CEO of North America, appearing behind Nuix 4, with new applications for defensible deletion and information governance.
OrcaTec announced its new appliance loaded with the Document Decisioning Suite for in-house analytics and predictive coding.
Powersearch appeared behind its downloadable “pay for results” search and cull software, now in V5.
Recommind introduced “Axcelerate Unlimited,” a new hosted offering starting at $10,000 for an unspecified volume of data. The company, which has historically been resistant to diluting its large license deals, characterizes this as an attempt to capture more down-market dollars on a transactional basis. It may be a great business move: it lowers the barrier to entry for adopters of Recommind’s predictive coding technology, and could lead to license up-sells. As predictive coding becomes more widespread, it’s also vital to competing with rivals offering case-by-case sales.
Service Provider RenewData, with new CEO, showcased RDC Analytics, its specialty consulting business around data volume reduction, and announced a patent for its Vestigate review tool.
Wave Software appeared behind Trident Pro 7.0 and the new Trident Collector.
ZyLAB announced a new General Manager of North America
