Withdrawal of Questions from 2010 Element 2 Technician Class Question Pool

Due to a proposed rule change and pending action by the FCC, the QPC is withdrawing the following questions:

1) T2C02 and T2C03 from the July 2010 Technician Pool effective July 1, 2010. However, VEC’s and publishers may take action to delete these immediately.


T2C02 (D) [97.113 and FCC Public Notice DA 09-2259]
Who must submit the request for a temporary waiver of Part 97.113 to allow amateur radio operators to provide communications on behalf of their employers during a government sponsored disaster drill?
A. Each amateur participating in the drill
B. Any employer participating in the drill
C. The local American Red Cross Chapter
D. The government agency sponsoring the event

T2C03 (C) [97.113]
When is it legal for an amateur licensee to provide communications on behalf of their employer during a government sponsored disaster drill or exercise?
A. Whenever the employer is a not-for-profit organization
B. Whenever there is a temporary need for the employer’s business continuity plan
C. Only when the FCC has granted a government-requested waiver
D. Only when the amateur is not receiving compensation from his employer for the activity

The above two questions are impacted by the following NPRM:

Adoption of the NPRM appears more likely than not, abolishing the temporary waiver (T2C02 ) and making T2C03 an invalid question. Therefore, we feel it is best to withdraw these two questions now to avoid the possible inclusion of invalid information in training material now being prepared.
