Our policy is to respond to clear notices of alleged copyright infringement and to terminate services provided to repeat infringers. The instructions below should make submitting notices of alleged infringement to bepress straightforward, while also reducing the number of notices that are fraudulent or difficult to understand or verify. Our required form of notice as specified below is consistent with the form suggested by the United States Digital Millennium Copyright Act (the text of which can be found at the U.S. Copyright Office Web Site).

We may respond to these notices by removing or disabling access to material claimed to infringe and/or terminating users of our services. If we remove or disable access in response to such a notice, we will make a good-faith attempt to contact the owner or administrator of the affected site or content so that the owner or administrator may make a counter notification. We may also document notices of alleged infringement on which we act. As with all legal notices, a copy of the notice may be made available to the public and sent to one or more third parties who may make it available to the public.

Notification of infringement involving bepress services or products

Your notice of infringement should conform to the instructions below, be written in English and either mailed to:

Improperly completed or incomplete notices may hinder our ability to respond to the notice or prevent us from responding altogether, so we ask that you follow all directions exactly.

Please note that the submission of false or misleading notices, or notices submitted in bad faith, is actionable and you may be held liable for damages (including court costs and attorneys' fees) sustained as a result of such submissions. Accordingly, if you are not sure whether material available online infringes your copyright, we suggest that you first contact an attorney.

Your notice should have six numbered sections with the following content.

  1. Identify the copyrighted work that you believe has been infringed (for example, pages 44-47 of the book "Mixed Motives" by James Quisit, published by Abromovitz Publishing in 1978, ISBN#4589394873748379.) If you believe that more than one work is being infringed, identify all works. We ask that you provide a detailed and complete description so that we can respond to your notice appropriately.
  2. Identify the material and the location that you claim is infringing the copyrighted work listed in item #1 above. For example, "The copyrighted work at issue is copied on pages 7-10 of the pdf found at www.bepress.com/cgi/viewcontent.cgi?article=1210&context=ev." If you believe many URLs are violating your copyright, please also send the list electronically to
  3. If the Web page containing the material that you claim is infringing identifies the Web page owner or administrator, please provide the contact information for that person, including the e-mail address, if available.
  4. Provide your name, address, telephone number, and, if available, email address.
  5. Include the following statement: "I believe in good faith that the use of the materials described in Paragraph 1 in the manner presented at the locations identified in Paragraph 2 is not authorized by the copyright owner, its agent, or the law."
  6. Include the following statement: "Under penalty of perjury, I swear, that the information in this notice is accurate and that I am either the owner or am authorized to act on behalf of the owner of an exclusive right under the Copyright Act that I believe is being infringed in the manner described in this notice."
  7. Sign the notice before sending it to us.

Counter Notification

After we contact the owner or administrator of the Web page, Web site, or content that you identified in your notice, that owner or administrator may make a counter notification in response to your notice. When we receive a counter notification, we may reinstate the material in question. We will, however, use reasonable efforts to contact you using the contact information you provide and will provide you with a copy of the counter notification.

Filing a Counter Notification with Us

If we remove or disable access to materials in response to an infringement notification, we use reasonable efforts to notify the affected subscriber and to provide that subscriber with a copy of the notice. The subscriber may elect to file a counter notification with us.

If, as a subscriber, you elect to submit a counter notification, your notice should have numbered sections with the following content.

  1. Identify the specific URLs or other unique identifying information of material that we have removed or to which we have disabled access.
  2. Provide your name, address, telephone number, email address, and a statement that you consent to the jurisdiction of the Federal District Court where your address is located, or if your address is outside the United States, the Federal District Court in Northern California, and that you will accept service of process from the person who submitted the infringement notice or an agent of such person.
  3. Include one of the following statements: "I swear, under penalty of perjury, that I believe in good faith that the materials identified in Paragraph 1 were removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.” OR "I swear, under penalty of perjury, that that the material identified by the complainant as allegedly infringing has been removed at the URL identified and will no longer be shown."
  4. Sign your counter notice before sending it.
