Writings

We write here and write elsewhere.

Most recently, Marvin wrote an e-book, about 30,000 words or 100 pages, called On Internet Freedom. Read it.

We both also write geeky, academic law review articles and more riveting, popular articles.

Marvin’s most recent law review article, on First Amendment issues of Internet regulation, earned the praise of Tim Wu, Susan Crawford, and MSNBC host Dylan Ratigan, among others. In April 2012, the Stanford Tech Law Journal devoted a third of its annual symposium to the piece. He has published two other articles on First Amendment doctrine and Internet policy, which are currently assigned to students taking free-speech courses at Harvard, Georgetown, and other law schools.  A previous article, on copyright, antitrust, and online television was republished for the 2011 UCLA Entertainment Law Symposium and for  Thompson West’s Entertainment, Publishing and the Arts Handbook (2011). He also co-authored a piece on network neutrality and cybersecurity with a senior lawyer at U.S. Cyber Command. While in law school, he won Harvard Law School’s award for the best student article on copyright law.

He also has published popular articles in in the New York Times on privacy  and network neutrality, in the Boston Review on innovation and government “corruption,” and in the Atlantic on copyright and the Supreme Court. Oh, he has also written for Wired several times and Slate. He also writes for Balkinization the Hufflington Post.

Luke recently authored a article on the legal framework applicable to computer network intrusions and “cyberespionage,” which will be forthcoming in the CommLaw Conspectus: Journal of Communications Law & Policy. He has published several op-eds in the Washington Times, the Daily Caller, and Fox News, and co-authored a few articles with Marvin in CNET and the Sacramento Bee.
