Personal injury trusts - protecting compensation sums

It may be beneficial to protect money received as your compensation award by founding a personal injury trust, particularly if a large sum has been awarded. The Clinical Negligence team at Blake Lapthorn solicitors would be happy to discuss this with you. Our aim would be to protect you – both in the immediate future, and in the longer term as your financial circumstances change and you grow older.

Although there is a cost to setting up a personal injury trust, it may save you money in the longer run and ensure your compensation is used wholly for your benefit. A personal injury trust can:

  • enable you to continue receiving means-tested benefits, including housing benefit and council tax benefit, and long-term care provision
  • preserve your compensation for your needs alone, and prevent its use by other family members
  • ensure that the compensation is not spent very rapidly, leaving you short of financial support in the longer term
  • put trustees in charge of managing your money and making sound investment decisions
  • protect you in later life when you may not have the mental capacity to manage your financial affairs
  • include provisions to protect your compensation in the event of marital break-up

If you would like your medical negligence compensation award to be paid into a personal injury trust, Blake Lapthorn solicitors can create the trust, and assist you in the appointment of trustees. We can also draw on the expertise of our tax and trust specialists. If needed, we are happy to act as trustees to administer the trust for your benefit.
