Personal injury trusts - protecting compensation sums
Although there is a cost to setting up a personal injury trust, it may save you money in the longer run and ensure your compensation is used wholly for your benefit. A personal injury trust can:
- enable you to continue receiving means-tested benefits, including housing benefit and council tax benefit, and long-term care provision
- preserve your compensation for your needs alone, and prevent its use by other family members
- ensure that the compensation is not spent very rapidly, leaving you short of financial support in the longer term
- put trustees in charge of managing your money and making sound investment decisions
- protect you in later life when you may not have the mental capacity to manage your financial affairs
- include provisions to protect your compensation in the event of marital break-up
