These Terms of Service (“TOS”) describe the the relationship between You (“You” or “the Users”) and redditgifts.com ("redditgifts" or “the Site”) and provide some rules about exchange gifts you purchase using the Reddit Marketplace. Please read these rules carefully! By using redditgifts.com, You agree to this TOS. You may only continue to use redditgifts.com as long as you continue to follow to this TOS.
We provide users with a service to allow Reddit.com users ("Reddit") to exchange gifts with other online users and to shop for gifts on-site at the redditgifts.com Marketplace. redditgifts.com helps create and manage gift exchange events. redditgifts.com automatically matches users of Reddit to a secret gift-giver from within a designated group. You must be registered to use the services that redditgifts.com provides.
Your use of the redditgifts.com Service is subject to all applicable local, state, national and international laws and regulations. It is your responsibility to understand whether the laws in your jurisdiction (where you access this website) prohibit services like this and whether any content or gifts you provide or send using this site are prohibited. We cannot offer this service to users under the age of 18.
By signing up for an exchange or otherwise using this Site, you are telling us that you are 18 years old or older and have the right, authority, and capacity to enter into this Agreement and to abide by all the Terms and Conditions of this Agreement.
We need you to provide true, accurate, current, and complete information about yourself in order to make the exchanges work! If you provide any information that is untrue, inaccurate, not current, or incomplete, or we have reason to think it is not true, we may suspend or terminate your account and ban your current and future use of the Service.
You are solely responsible for maintaining the confidentiality of your password and account. You are also solely responsible for any and all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security known to you. You must promptly inform us of actual or apparent breaches of security, such as loss, theft, or an authorized disclosure or use of a User Account or password. Until we are notified by email of a breach in security, you will remain liable for any unauthorized use of the redditgifts.com Service through your account.
We takes your privacy very seriously. All the data you share using redditgifts.com’s Services is subject to and protected by our Privacy Policy . The Privacy Policy incorporates and is incorporated into this TOS. Please read it carefully!
Our Service includes the redditgifts.com Marketplace, which offers selected merchants the option to provide their goods directly to Users on the redditgifts.com Site, so that you never have to leave the Site to buy gifts.
The Marketplace is only a platform for connecting you to merchants. redditgifts.com is not directly involved in any transactions or disputes among Users, Marketplace merchants, or gift recipients to whom Users ship Marketplace purchases. Nor is redditgifts.com responsible for the content or communications of Marketplace merchants, Users, or gift recipients.
Any issue a User has concerning a refund, return, or dispute with a Marketplace merchant will be handled exclusively by the merchant, per their terms and policies, not by redditgifts.com. redditgifts.com’s sole connection to the refund and return policy is to reserve the ability to cancel orders and deposits when a buyer cancels an order or returns it within 21 days. Beyond this reservation, redditgifts.com has no connection with or ability to arbitrate or otherwise interact in disputes among buyers, recipients, and merchants.

When you place an order on the Marketplace, redditgifts.com will process your payment information using a third-party service provider, Balanced (see more information about Balanced below). redditgifts.com will notify you by email when and if your payment is accepted and your order is shipped by the merchant.
If you follow a link from a merchant’s product, profile, or catalogue page, your use of those websites and services is governed by those third parties’ terms of services and other user agreements, not this TOS.
redditgifts.com uses Balanced as third-party service providers for payment services (e.g. card acceptance, merchant settlement, and related services). By making use of some or all of these payment services on the Marketplace, you agree to be bound by Balanced’s terms and conditions (available at https://www.balancedpayments.com/terms), along with its privacy policy (available at https://www.balancedpayments.com/privacy). You also hereby consent and authorize redditgifts.com to delegate the authorizations and to share the information you provide to redditgifts.com with our third-party service provider(s), to the extent required to provide payment services to you.

We Are Not Responsible for Shipping: Please keep your own shipping records for the gift you are sending. redditgifts.com makes no warranties, expressed or implied, that your package will be delivered to its intended recipient. All shipping responsibilities lie with you, the gift-sender.
We have the right (but not the obligation), in our sole discretion, to refuse or remove any Content that is available via the Service for any reason. We do not monitor, control, or assume any responsibility for any user’s Content or conduct and, as such, we cannot guarantee the accuracy, integrity, or quality of such Content or conduct. By using our Service you understand and agree that you may be exposed to other users’ Content or conduct that you may find offensive, indecent or objectionable. Under no circumstances will redditgifts.com be liable in any way for any Content posted by or conduct undertaken by any user or third party, including (but not limited to) liability for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, e-mailed, or otherwise transmitted via the Service.
redditgifts gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the gift exchange and other software that is part of our Services. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by us, and in compliance with these Terms.
You agree that you will not send any of the following items in a gift exchange: Unauthorized duplications of copyrighted material such as music, television shows, films and other forms of media; illegal or hazardous drugs; weapons of any type; any material that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable; any material that may promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, promote any act of cruelty to animals, provide instructions on how to assemble bombs, grenades and other weapons, or explain how to bypass any third party website's security; or any material that may harm a minor in any way.
✴ It is your sole responsibility to make sure you are sending an item that is not illegal. You acknowledge that redditgifts.com has no way of examining or verifying the contents of packages that are mailed, and it is up to you to make sure that what you send is legal. If you feel you have received an item that may violate any law or regulation, please report it to your local law enforcement agency, not redditgifts.com. We will not accept any packages sent to us from Users in relation to this gift exchange.
You agree to indemnify and hold harmless redditgifts.com, as well as its subsidiaries, affiliates, officers, agents, co-branders, other partners, employees, successors, and assigns, from any claim or demand (including reasonable attorneys' fees) made by any third party due to or arising out of your use of the redditgifts.com Service, your violation of this TOS, your infringement (or infringement by another user of the Service using your account) of any intellectual property or other right of any person or entity, or your violation of any federal, state or local law or regulation.
We Can Terminate Your account: You agree that redditgifts.com, in its sole discretion, may terminate your account, the redditgifts.com Site, your use of the Service or of any other redditgifts.com service, and may remove and discard any Content within the Service, for any reason, including (without limitation) for lack of use or if redditgifts.com believes that you have violated or acted inconsistently with the TOS.
We Can Terminate This service: redditgifts.com may also in its sole discretion and at any time discontinue the Service or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this TOS may be effected without prior notice, and you acknowledge and agree that redditgifts.com may immediately deactivate or delete your redditgifts.com event and all related information and files, and/or may bar any further access to such files or the Service.
Further, you agree that redditgifts.com shall not be liable to you or any third party for any termination of your access to the Service. There are no refunds, credits or compensation of any kind for termination of your participation in the gift exchange activity or the redditgifts.com site.
You Can Terminate your Participation: You may terminate your participation in the redditgifts.com Service, with or without cause, at any time and effective immediately.
Should you object to any terms and conditions of the TOS or any subsequent modifications redditgifts.com makes to the TOS or become dissatisfied with the redditgifts.com Service in any way, your only recourse is to immediately discontinue use of the redditgifts.com Service and notify redditgifts.com of your termination and, at your discretion, the reasons for your termination. Upon termination of your use of the redditgifts.com Service, your right to use the redditgifts.com Service shall cease immediately. You shall have no right, and redditgifts.com will have no obligation thereafter, to forward any unread or unsent messages to your or any third party on your behalf.
YOU EXPRESSLY AGREE THAT YOUR USE OF THE REDDITGIFTS.COM SERVICE IS AT YOUR SOLE RISK. THE REDDITGIFTS.COM SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. REDDITGIFTS.COM EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
REDDITGIFTS.COM MAKES NO WARRANTY THAT ITS SERVICE WILL MEET YOUR REQUIREMENTS, OR THAT ITS SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE. REDDITGIFTS.COM ASSUMES NO RESPONSIBILITY FOR AND MAKES NO WARRANTY OR REPRESENTATION AS TO THE ACCURACY, CURRENCY, COMPLETENESS, RELIABILITY, USEFULNESS, OR DECENCY OF CONTENT OR PRODUCTS DISTRIBUTED OR MADE AVAILABLE BY THIRD PARTIES THROUGH THE REDDITGIFTS.COM SERVICE.
REDDITGIFTS.COM MAKES NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH ITS SERVICE OR ANY TRANSACTIONS SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
REDDITGIFTS.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING (BUT NOT LIMITED TO) DAMAGES FOR LOSS OF PROFITS, USE, DATA, OR OTHER INTANGIBLES, EVEN IF REDDITGIFTS.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RESULTING FROM (I) THE USE OR THE INABILITY TO USE THE SERVICE; (II) COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES; (III) ANY GOODS OR SERVICES PURCHASED OR OBTAINED, CONTENT RECEIVED, OR TRANSACTIONS ENTERED INTO WITH REDDITGIFTS.COM OR A THIRD PARTY THROUGH THE USE OF THE REDDITGIFTS.COM SERVICE; OR (IV) RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR ALTERATION OF YOUR ACCOUNT OR DATA.
YOU SPECIFICALLY AGREE THAT REDDITGIFTS.COM IS NOT RESPONSIBLE OR LIABLE TO YOU OR ANYONE ELSE FOR ANY UNLAWFUL, HARASSING, DEFAMATORY, ABUSIVE, THREATENING, HARMFUL, VULGAR, OBSCENE, SEXUALLY EXPLICIT, OR OTHERWISE OBJECTIONABLE CONDUCT OR SPEECH OF ANY OTHER PARTY ON OR THROUGH THE REDDITGIFTS.COM SERVICE, OR FOR ANY INFRINGEMENT OR VIOLATION OF YOUR RIGHTS BY ANY OTHER PARTY, INCLUDING BUT NOT LIMITED TO INTELLECTUAL PROPERTY RIGHTS, RIGHTS OF PUBLICITY, OR RIGHTS OF PRIVACY.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO USER.
This TOS shall be governed by and construed in accordance with the laws of the State of California and the laws of the United States, without giving effect to any principles of conflicts of law.
If any part of this Agreement is held unenforceable, all remaining provisions of this Agreement will remain in full force and effect. If at any point redditgifts.com does not enforce any provisions of this Agreement, that is not to be taken as a waiver of our right to enforce those provisions in the future.
This TOS is not assignable, transferable or sub-licensable by you except with redditgifts.com’s prior written consent, but may be assigned or transferred by redditgifts.com without restriction. Any assignment attempted in violation of the TOS shall be void.
redditgifts.com, in its sole discretion, may change this TOS at any time. In the event of any material or substantial change to this TOS, the Service, the Privacy Policy, or other matters of importance, redditgifts.com will notify you via e-mail or by posting an announcement on the redditgifts.com Service. Your using the redditgifts.com Service after any change in the TOS, the Service, the Privacy Policy, have been broadcast, constitutes your acknowledgement and acceptance of the changes.
