The last UK government failed to pass a law as part of the Digital Economy Bill to allow Orphan Works (images for which the owner cannot be traced) to be used commercially. Their proposals to collect a fee for their use, and remove the rights that photographers and artists have over those images failed, and Stop43 were instrumental in getting that Clause (Clause 43) removed from the Bill.
However, the new government has now commissioned a report into intellectual property called the Hargreaves Report, and also published their response to it ahead of new proposals to change copyright legislation in the Communications Bill this Autumn. Sufice to say, both reports contain some good proposals (improved legal process) and some bad (commercial use of Orphan Works), all of which we have responded to (see our main website). As a result, we have now been asked to participate in the official consultation process.
Our tenets are:-
- No commercial use of Orphan Works; Cultural Use encouraged
- Automatic, unwaivable Moral Rights
- Small Claims fast track through the courts for IP cases
- Fair Contract law for IP
- Effective penalties for copyright infringement
- An IP Ombudsman to arbitrate in disputes
- An online copyright and rights registry, Cultural Use gallery, and commercial rights exchange
- No Extended Collective Licensing of any works
