Mr. "I have unlimited resources"

It's not a secret that there are copyright laws we're forced to live by.

It's not a secret that Bitsnoop gets on average 30 emails per day with DMCA notices to remove specific torrents - we index millions of them, so some copyrighted stuff manages to sneak into the index.

We usually remove torrents in a timely manner, as long as the notice we recive is not written by a complete moron.

Here's one of such notices and the following email exchange:

That might work with others but it won't work with me you are nothing but a bootlegger, pirate and infringer. Why don't you try actually creating something someday as opposed to just stealing other people's work. But that would mean you'd have to be creative and actually do something worthwhile. Now that is insulting - Bitsnoop is a work of art, and developing it is several magnitudes more complicated than "producing" (paying money to writers and actors) some radio shows.

Today we've got a long letter from BREIN, demanding to shut down the site, bend over and take it up the arse.

Yes, the very same Dutch people (headed by Tim Kuk) who push for total internet censorship and work very hard on turning NL into a "hosting wasteland (c) One Smart Guy".

The very same Mr. Kuk (or was it Kuik?) who likes to tell in public how successful they are in closing a gazhillion of torrent sites - failing to produce any evidence of his words.

Apparently, lying and sucking on RIAA/MPAA dic funding is nice?

We eagerly await for BREIN to start trumpeting how they shut down that nasty, nasty Bitsnoop. Meanwhile, feel free to enjoy our site as usual. :D

By operating that system which facilitates, enables and participates in the distribution of infringing files, you are acting unlawful and violate the copyrights and neighbouring rights of others, including the rights holders represented by BREIN. This causes extensive damage to rights holders for which you and others involved with the management of the site are liable. As you are operating in full anonimity, BREIN and its rights holders at present are unable to recover damages from you and your organization.

Your actions also constitute a crime punishable under Dutch law. In the event gravity and extent so warrant, the public prosecution may proceed with criminal investigation and prosecution. In the course of such investigation servers and administration may be confiscated and suspects of a crime may be arrested and taken into custody. The maximum punishment for (aiding and abetting) professional infringement is 4 years imprisonment or 67.000 euro fine for natural persons and 670.000 euro for legal entities. In addition the prosecution usually claims the proceeds of the criminal activity. At the same time injured parties can join the criminal action in order to obtain damages or file civil action to claim those. With respect to these criminal actions BREIN emphasizes that these too are not theoretical. Christine Filipak Strikes Back - Abusing DMCA This Time

Nice try, Christine, a new low!

We've got a notice from Blogger.com that someone (not hard to guess) filed DMCA takedown against our previous post about Christine Filipak and her fight to own internets.

She decided to abuse DMCA, as there is nothing in that post infringing on anyone's rights.

We would expect that self-proclaimed "manager" of self-proclaimed "musicians" Nox Arcana knows that abusing DMCA is illegal under US laws.

We ask you again - do not buy their music. There are hundreds of really talented artists who might use that money well.

Christine Filipak - Copyright Goth Strikes Again

Oh boy, are we excited!

We've just got a letter from Christine Filipak, the Copyright Goth, demanding to censor search. Again.

If you remember, she is the person who believes that P2P users are pedophiles and has another personality - sends threats and insults signed "Russel" (same e-mail, same IP address and same Apple computer).

She also tried to wage her little internet war - attempting to assasinate characters of several unrelated persons with accusations of child pornography, pedophilia and whatever she could imagine else.

When she was caught lying - she lied even more.

One more detail - she poses as being Goth and prints books about desires to have sex with vampires. No, it's not a tasteless joke.

Got the picture what kind of creature we are dealing with?

Christine really believes that she has copyrights on words and parts of countries. How sad indeed.

Another nail in the coffin is an amazing lack of any technical knowledge whatsoever, demanding us to block hash codes "from our trackers". This idiom might be missed, as Christine will think we're trying to get kinky with her, mentioning coffins.

Some people never learn, do they?

Now, here's the deal: torrent in question is deleted from Bitsnoop (as we keep our site strictly legal). Guess you can use internets, right?

A bit of personal opinion - if you decide to buy this "music", do not do it. It is crap.

The story with McHost.ru / Oversun.ru and Bitsnoop

First of all - things are going fantastic, we're about a week away from re-launch, once we finish setup of new server for new, greatly improved Bitsnoop!

As some of you already know we used to host with provider McHost.ru (known as "McHost" and "Mercuriusz").

After they've destoryed all data on our server in February, we've posted a comment in our blog - mentioning company Oversun.ru / Oversun-Mercury.ru as related to that mess.

In just couple of hours person, who registered account with McHost.ru, was contacted by Oversun Group legal - Ms. Eugenia Suprun, head of department. Email was sent to our employee personal email and using his personal details, known only to McHost.ru.

Ms. Suprun wrote: "I represent the OVERSUN Group of Companies (hereinafter referred to as «the OVERSUN Group») that among other members includes «Oversun» LLC and «Oversun-Mercury» LLC («Mercury LLC»). It has come to my attention that you have spread invalid information that tarnishes business reputation of the OVERSUN Group....We would like to inform you that «McHost» LLC is strictly our client, and we have no powers over its actions and in what ways «McHost» LLC does its business." Etcetera, etcetera.

We've removed mentions of Oversun Group - server was pre-paid and we wanted to use it to rebuild index for some time.

Ms. Suprun ignored our questions on how did she acquire our employee personal data (which was provided only to McHost).

Turns our, Ms. Suprun (Head of Legal Department, Oversun Group) was lying, plain and simple - both Oversun and McHost were the very same company. Now management is trying to split these two business.

At 6th of April Oversun cut uplinks for data-centre with about 20-30 thousand sites (with 30-minute unofficial warning), including one of our indexing servers. It's still offline - after 24 hours.

Oversun was very "kind" to server owners, by letting download some of the data for backup. Trying to sell them colocation services at the same time.

McHost is already sold to third party, as Oversun is not interested in small-time hosting. They want to make it big!

So, a word of advice - DO NOT have any business with "McHost", "Oversun", "Oversun-Mercury", "Oversun-Skalaxy" or their agents.

They will shut down your servers - as a PR move to sell your hosting contract to highest bidder. Not mentioning destruction of your RAID array with 70-dollar reimbursement.

P.S. We're fine, we backup stuff. :)

Some good news at last!

In the most unexpected turn of events Christine's Filipak defamation attempts at us resulted in something good - users of isoHunt.com are seting up a protest group against child abuse.
